These terms of use govern the use of the application provided by Omnora GmbH at app.omnora.com (the "Application") by registered users.
§ 1 Scope
These terms of use apply to the use of the app.omnora.com application by all registered users. They supplement the contractual agreements concluded between Omnora and the respective customer company (in particular the General Terms and Conditions) and govern the relationship between Omnora and the individual user in connection with day-to-day use of the Application.
§ 2 Registration and user account
Using the Application requires registration with a business email address. The use of private email addresses, as well as pseudonyms or clearly fictitious names, is not permitted; user accounts must be set up using the real name of the respective individual. The contract language for the use of the Application and for communication relating to the user account is German, unless expressly agreed otherwise.
§ 3 Availability and restriction of access
Omnora reserves the right to restrict or block access to the Application in individual cases, for example if a breach of these terms of use is suspected, in the event of abusive use, or for reasons of IT security. The Application may be temporarily unavailable or only available to a limited extent for the purpose of carrying out maintenance, updates, and security measures. Omnora will endeavor to keep such interruptions to a necessary minimum and, where possible, to carry them out outside normal business hours.
§ 4 Obligations of users
Users undertake to use the Application solely in accordance with applicable law. In particular, it is prohibited to create, upload, or distribute content via the Application that contains racist, violence-glorifying, or extremist material, harasses or discriminates against other individuals, is pornographic in nature, or defames or disparages third parties. A breach of these obligations entitles Omnora to immediately suspend the user account concerned.
§ 5 Access credentials and account security
Access credentials (username and password) must be treated as strictly confidential by users and protected from access by third parties. Sharing one's own access credentials with other individuals, as well as joint use of a single user account by multiple individuals, is not permitted. Automated retrieval of content from the Application (scraping) and any other form of automated abuse of the Application are prohibited. Omnora must be informed immediately if unauthorized access to one's own user account is suspected.
§ 6 Liability
Omnora is liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or grossly negligent breach of duty, as well as for other damages caused by an intentional or grossly negligent breach of duty by Omnora or its legal representatives or vicarious agents. Liability under the German Product Liability Act remains unaffected.
In the case of ordinary negligence, Omnora's liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded, unless a material contractual obligation (cardinal obligation) was breached, that is, an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely.
§ 7 Indemnification
Users shall indemnify Omnora against all third-party claims arising from a breach of these terms of use or from any other unlawful use of the Application by the respective individual. This also includes reimbursement of reasonable legal defense costs. This indemnification obligation does not apply insofar as the respective individual is not responsible for the breach.
§ 8 Processing of personal data
By registering, users consent to the storage and processing of personal data arising from their use of the Application, including their IP address, for the purpose of operating, securing, and improving the Application. Further information can be found in our privacy policy.
